In celebration of Dog Person Day, The Farmer’s Dog, Inc. is sponsoring two (2) giveaways to celebrate its customers: (1) Dog Person Day New Customer Giveaway (“Giveaway”) available to new and returning customers who sign up in a specific time period outlined below and (2) a Dog Person Day Current Customer Gift Giveaway (“Gift Giveaway”) into which all current subscribers as of September 20, 2025 at 11:59 PM EST will be automatically entered.

Section I: Dog Person Day New Customer Giveaway (“Giveaway”) Official Rules

Sponsor. The Dog Person Day New Customer Giveaway is sponsored by The Farmer’s Dog, Inc. (“Sponsor”).

Eligibility. Open only to legal residents of the 48 contiguous United States and Washington, D.C. aged at least 18 years or age of majority, whichever is greater. Employees of Sponsor, and members of their households, are not eligible to enter. Eligibility qualification subject to Sponsor review and determined in Sponsor’s sole discretion. Void where prohibited by law. No purchase is necessary to enter or win.

Entry Period. Entry period commences on September 21, 2025 at 12:00 AM ET and ends on September 28, 2025 at 11:59 PM ET (“Entry Period”). Sponsor’s clock shall be the official timekeeper for the Giveaway.

Odds. Odds depend on the number of eligible entries received.

How to Enter. There are two ways to enter. (1) If you subscribe to The Farmer’s Dog (at TheFarmersDog.com) by starting a trial or purchasing a box as a new or returning customer during the Entry Period and maintain that subscription through the end of the Entry Period, you will automatically be entered (“Entry Method 1”) (2) You may alternatively submit an entry without a subscription by navigating directly to https://thefarmersdog.typeform.com/dogpersonday and entering the required information (“Entry Method 2”). You may be presented with an optional checkbox to opt into marketing communications from The Farmer’s Dog – entry is not dependent on opting in; however, by entering, you are agreeing to receive communications from The Farmer’s Dog regarding administration of this Giveaway. Limit one (1) entry total, regardless of method of entry, per person and per email address. To opt-out of being included in the drawing for the chance to win a prize, email giveaways@thefarmersdog.com with the name of the Giveaway (as given above) and the following statement “I would like to be excluded from participation in this Giveaway.”

Entering constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to this Giveaway. Winning a prize is contingent upon fulfilling all requirements as set forth herein. Sponsor and its respective parent companies, subsidiaries, suppliers, distributors, prize suppliers, advertising and promotional agencies, and each of their respective officers, directors, employees and agents (collectively, “Affiliates”) are not liable for any injury or damage to your or any other person’s computer or its contents relating to or resulting from participating in or downloading any materials concerning this Giveaway, or from other technical difficulties, failures or other errors of any kind. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Giveaway, as solely determined by Sponsor. In the event that the Giveaway is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupt or impair the administration, security, fairness or proper operation of the Giveaway, Sponsor reserves the right, in its sole discretion, to suspend, modify or terminate the Giveaway. Should the Giveaway be terminated prior to the stated expiration date, Sponsor reserves the right to award the prize based on the non-suspect, eligible entries received before the termination date.

ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitations. Limit one (1) entry per person and per email address. A single email address may only be associated with one person. Any attempt to enter more than the stated amount will be deemed void. Any attempt to enter before or after the designated dates and times of the Entry Period will be deemed void. All entries must be fully and accurately completed and in compliance with these Official Rules. Use of any automated system to participate in the Giveaway or to subvert the entry process is prohibited and will result in disqualification and all associated entries will be void.

Prize. 1 winner from combined Giveaway Entry Method 1 and Entry Method 2 will be randomly selected to win one (1) voucher for one (1) year of fresh dog food subscription from The Farmer’s Dog, not to exceed $4,999.00, for any one (1) dog, to be delivered monthly and/or according to plan needs, but not all at once. Voucher applies to food supplied by The Farmer’s Dog, tax, and shipping.

Approximate retail value varies, as it is dependent on the quantity of food indicated in personalized plan designed for selected dog. This is determined by a number of factors including but not limited to dog age, weight, size, breed, activity level, and more. Estimated minimum retail value is approximately $700.00 USD, average retail value $2,000.00 USD. Value not to exceed $4,999.00 USD. 

Entry into Giveaway using Entry Method 2 constitutes acknowledgement that in order for prize to be redeemed and administered, winner will be required to provide information to Sponsor necessary to facilitate delivery and management of prize to winner (including delivery address, contact email and phone number), as well as information about their dog’s needs that allows Sponsor to recommend, produce and deliver a one year feeding plan. No payment is required (unless winner opts to order additional products or amounts beyond the recommended plan, such as adding treats or an additional dog), nor will winner be required to opt into marketing emails or other communications not related to their order.   

Prize is non-transferable, non-exchangeable, and has no cash value. There are no cash substitutions. If a prize becomes unavailable, or at Sponsor’s sole discretion, Sponsor may award substitute prizes of comparable or greater value. All prize details are at Sponsor’s sole discretion.

How to Win. On or about September 30, 2025, Sponsor will randomly select potential winner. Sponsor will notify potential winner by email to the email address provided upon entry and/or associated with their existing account. Failure to reach a potential winner by email after three (3) attempts may result in the disqualification of that potential winner and forfeiture of the potential winner’s interest in the prize, at the sole discretion of Sponsor. Sponsor, in its sole discretion, may attempt to select alternate potential winner(s) by random drawing from among all remaining eligible entries, and will make good faith attempts to award the prize in its sole discretion but shall not be required to do so. A selected potential winner may waive the right to receive a prize. Sponsor is not responsible for any lost, misdirected, garbled, delayed, unintelligible, or late email notifications.

Potential winner may be required to complete an Affidavit of Eligibility/Liability and Publicity and Prize Release (“Affidavit”) (except where prohibited by law) which must be returned as directed by Sponsor in order to claim the prize. Failure to complete, sign and return the Affidavit, or to comply with any term or condition of these Official Rules, will result in a potential winner’s disqualification, the forfeiture of his/her interest in the prize, and the potential award of the prize to an alternate winner. Prize will only be provided with the winner’s consent. In the event a winner does not consent to receive a prize, an alternate winner may be selected. The decisions of Sponsor regarding the selection of winners and all other aspects of the Giveaway shall be final and binding in all respects. 

Miscellaneous. Sponsor and its respective Affiliates are not responsible for incomplete, inaccurate, illegible, unintelligible, damaged, lost, late, misdirected, delayed or garbled entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Giveaway including, without limitation, errors or difficulties which may occur in connection with its administration, the processing of entries, the announcement of a prize or in any related materials. In the event of a dispute of who submitted an online entry, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent and that person must comply with these Official Rules. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Giveaway. All entries become the property of Sponsor and will not be acknowledged or returned. Winners are solely responsible for reporting and payment of any and all taxes on prize received, if applicable. One (1) total winner will be randomly selected to win one (1) voucher for one (1) year of a dog food subscription from TFD, not to exceed $4,999.00. Voucher applies to food supplied by The Farmer’s Dog, tax, and shipping. Food to winner applies to one (1) dog – exact product and volume based on size/breed of winners’ dog. ARV: Average retail value $2,000.00 USD, depending on personalized price based on winner’s dogs.

Release of Liability. By entering the Giveaway, Entrant agrees to (a) be bound by these Official Rules and the decisions of Sponsor, which shall be final and binding, and (b) release and hold harmless Sponsor and its respective Affiliates from and against any and all claims, suits, causes of action or other proceedings of any kind for losses, costs, damages or other liabilities of any kind arising out of or relating to participation in the Giveaway and/or acceptance and/or use of any Giveaway prize, including without limitation, due to personal injury, death, and/or property damage; claims based on publicity rights, defamation or invasion of privacy. 

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS GIVEAWAY, INCLUDING THE PRIZE, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

Publicity. Except where prohibited, acceptance by winner of the Giveaway prize constitutes Winner’s consent to Sponsor’s use of both and/or either of Winner’s and Winner’s dog’s name, likeness, photograph, voice, opinion, and/or city and state of residence for any commercial or promotional purpose in any and all media, now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission.

Privacy Policy. Giveaway is subject to Sponsor’s privacy policy which can be accessed and reviewed at https://www.thefarmersdog.com/content/privacy. 

Disputes. Any dispute or claim arising in any way from the Giveaway shall be resolved by binding arbitration, rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages). The arbitration will be conducted before a neutral single arbitrator, whose decision will be final and binding, and the arbitral proceedings shall be governed by the AAA Commercial Arbitration Rules, Consumer Due Process Protocol, and Supplementary Procedures for Resolution of Consumer Related Disputes. To begin an arbitration proceeding, you must send Sponsor a notice of dispute, in writing, setting forth your name, address and contact information, the facts of the dispute and relief requested. You must send your notice of legal dispute to Sponsor at the following address: info@thefarmersdog.com. We will send any notice of dispute to you at the contact information we have for you.

If a court of competent jurisdiction finds the foregoing arbitration provisions invalid or inapplicable, you and The Farmer’s Dog each agree to the exclusive jurisdiction of the federal and state courts located in New York County, New York, and you and The Farmer’s Dog each agree to submit to the exercise of personal jurisdiction of such courts for the purposes of litigating any applicable dispute or claim.

In no event shall any claim, action or proceeding by you or The Farmer’s Dog be instituted more than one (1) year after the close of the Entry Period.

This Giveaway is governed by, and shall be construed in accordance with, the laws of the State of New York, without resort to conflict of laws principles.

THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY ENTRANT SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE ENTRY PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial. Disputes. Any dispute or claim arising in any way from the Giveaway shall be resolved by binding arbitration, rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages). The arbitration will be conducted before a neutral single arbitrator, whose decision will be final and binding, and the arbitral proceedings shall be governed by the AAA Commercial Arbitration Rules, Consumer Due Process Protocol, and Supplementary Procedures for Resolution of Consumer Related Disputes. To begin an arbitration proceeding, you must send Sponsor a notice of dispute, in writing, setting forth your name, address and contact information, the facts of the dispute and relief requested. You must send your notice of legal dispute to Sponsor at the following address: info@thefarmersdog.com. We will send any notice of dispute to you at the contact information we have for you.

If a court of competent jurisdiction finds the foregoing arbitration provisions invalid or inapplicable, you and The Farmer’s Dog each agree to the exclusive jurisdiction of the federal and state courts located in New York County, New York, and you and The Farmer’s Dog each agree to submit to the exercise of personal jurisdiction of such courts for the purposes of litigating any applicable dispute or claim.

In no event shall any claim, action or proceeding by you or The Farmer’s Dog be instituted more than one (1) year after the close of the Entry Period.

This Giveaway is governed by, and shall be construed in accordance with, the laws of the State of New York, without resort to conflict of laws principles.

THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY ENTRANT SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE ENTRY PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial. ANY AND ALL PROCEEDINGS TO RESOLVE OR LITIGATE A DISPUTE IN ANY FORUM SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS.

Section III – Limited Satisfaction Guarantee (alt. Limited Money-Back Guarantee)
for New Trial Customers 

At The Farmer’s Dog, the satisfaction of our customers trying our food for the first time is so important to us that we went ahead and guaranteed it.  When you order a trial box of fresh food from The Farmer’s Dog for the first time, if you are not completely satisfied with your order, we’ll refund the full amount you paid for it.

The refund will be equal to the amount paid for the trial box at the time of purchase, inclusive of sales tax and shipping costs (if any). If you received a discount on the trial box, the refund amount will reflect the discounted price, not the full retail price.  The funds will be returned via the credit card used for the original purchase.

Guarantee Limitations/Restrictions:

• This Guarantee applies only to first-time customers of The Farmer’s Dog that purchase a trial box of fresh food.
• This Guarantee applies only to the first trial box and cannot be used for subsequent orders.
• Refunds are limited to one per household.
• The Farmer’s Dog reserves the right to deny refund requests suspected to be fraudulent or abusive at our discretion.
• The Guarantee does not apply to:
  • Products damaged due to improper storage or handling.
  • Bulk or wholesale purchases.
  • Subscription renewals beyond the trial box or purchases made through third-party platforms.

How to Request a Refund:

• Customers must request a refund within 14 days of receiving their trial box.
• To initiate a refund, customers must contact our Customer Support Team at care@thefarmersdog.com (mailto link).
• Refund requests must include:
  • Order number
  • Reason for dissatisfaction
  • Confirmation that the product was used as directed
• Refunds will be processed within 10 business days after approval.

Changes to Policy:

The Farmer’s Dog reserves the right to modify or discontinue this Satisfaction Guarantee at any time. Any changes will be posted on our website and will apply to future purchases.
